Terms of Service

The terms that govern quotations, installations and ongoing service from AkiliSolar.

1. These terms

These terms govern quotations, supply, installation and ongoing service provided by AkiliSolar. Where you have signed a separate project contract with us, that contract takes precedence over anything inconsistent here.

Nothing in these terms removes any right you have under the Consumer Protection Act, 2012 or other applicable Kenyan law.

2. Quotations and site surveys

Quotations are based on the site survey and on the load information you give us. If site conditions turn out to differ materially from what was surveyed — roof structure, wiring condition, access, or actual load — we will tell you and re-quote before doing further work.

Unless stated otherwise on the document, a quotation is valid for 30 days. Equipment prices can move with exchange rates and import duties, and we will confirm the price before we order.

Figures produced by the loan calculator on this site are indicative only. They are not an offer of credit. Final financing terms are set by the bank on approval.

3. Your responsibilities

You confirm that you own the premises or have the owner's permission to install, and that you will give our team safe and reasonable access on the agreed dates.

You are responsible for the accuracy of the load and consumption information you provide, and for telling us about anything on site that affects safety.

Where a landlord, management company or county approval is needed, obtaining it is your responsibility unless we have agreed in writing to handle it.

4. Installation and commissioning

Installations are carried out by certified engineers and technicians, and are commissioned only once safety and efficiency standards have been met and the system has been tested.

Our installations are fully insured. Where it forms part of the agreed scope, we install CCTV around installation points for added security.

Installation dates are our best estimate. We are not liable for delays caused by weather, supplier lead times, utility or regulatory approvals, or access we were not given.

Grid-tie systems require the relevant utility and regulatory approvals. We will support the application, but we cannot guarantee the outcome or the timeline of a third party's decision.

5. Payment

Payment milestones are set out in your project contract — typically a deposit on order, a payment on delivery of equipment, and a balance on commissioning.

Equipment remains our property until it has been paid for in full. Risk in the equipment passes to you on delivery to site.

Where the project is financed, disbursement follows the schedule agreed with the bank.

6. Warranty

Solar modules, inverters and batteries carry the manufacturer's warranty applicable to the Tier-1 components specified in your quotation. Full detail is set out in the Warranty Policy.

Our workmanship is warranted separately, on the terms set out in your project contract.

7. Operation and maintenance

Our operation and upkeep service provides long-term monitoring and scheduled maintenance to protect system yield. Its scope and duration are set out in your service agreement.

Performance depends on irradiance, weather, shading, and how the system is actually loaded. Any yield figures we give are engineering estimates, not guarantees of output.

8. Cancellation and changes

Cancellation, return and refund terms are set out in the Returns, Refunds & Cancellations policy.

Any change to the agreed scope must be recorded in writing, and may affect both the price and the schedule.

9. Limitation of liability

We are not liable for loss arising from grid conditions outside our control, from unauthorised modification of an installed system, from use of the system outside its designed load profile, or from information you gave us that was inaccurate.

We do not exclude or limit liability for death or personal injury caused by our negligence, for fraud, or for anything else that cannot lawfully be excluded.

Subject to the paragraph above, our total liability in connection with a project is limited to the amount you paid us for that project.

10. Governing law

These terms are governed by the laws of Kenya. We will try to resolve any dispute with you directly first; if we cannot, the courts of Kenya have jurisdiction.
